Pengusaha Kena Pajak (PKP) adalah Pengusaha yang melakukan penyerahan Barang Kena Pajak dan atau penyerahan Jasa Kena Pajak yang dikenakan pajak berdasarkan Undang-undang Pajak Pertambahan Nilai (UU PPN) 1984 dan pembaharuannya, tidak termasuk Pengusaha Kecil yang batasannya ditetapkan dengan Keputusan Menteri Keuangan, kecuali Pengusaha Kecil yang memilih untuk dikukuhkan sebagai Pengusaha Kena Pajak.

Fungsi Pengukuhan PKP
* Pengawasan dalam melaksanakan hak dan kewajiban PKP di bidang PPN dan PPn BM.
* Sebagai identitas PKP yang bersangkutan.

Tata Cara Pemberian serta Pelaporan dan Pengukuhan Pengusaha Kena Pajak (PKP)
* Pengusaha yang dikenakan Pajak Pertambahan Nilai (PPN), wajib melaporkan usahanya pada KPP yang wilayah kerjanya meliputi tempat tinggal atau tempat kedudukan Pengusaha dan tempat kegiatan usaha dilakukan untuk dikukuhkan menjadi PKP.
* Pengusaha Orang Pribadi atau Badan yang mempunyai tempat kegiatan usaha berbeda dengan tempat tinggal, wajib melaporkan usahanya untuk dikukuhkan sebagai PKP ke KPP yang wilayah kerjanya meliputi tempat tinggal atau tempat kedudukan, juga wajib mendaftarkan diri ke KPP di tempat kegiatan usaha dilakukan.
* Pengusaha kecil yang memilih untuk dikukuhkan sebagai PKP wajib mengajukan pernyataan tertulis untuk dikukuhkan sebagai PKP.
* Pengusaha kecil yang tidak memilih untuk dikukuhkan sebagai PKP tetapi sampai dengan suatu masa pajak dalam suatu tahun buku seluruh nilai peredaran bruto telah melampaui batasan yang ditentukan sebagai pengusaha kecil, wajib melaporkan usahanya untuk dikukuhkan sebagai PKP paling lambat akhir masa pajak berikutnya.

Pengukuhan PKP Secara Jabatan
KPP dapat mengukuhkan PKP secara jabatan, apabila WP tidak melaporkan usahanya untuk dikukuhkan sebagai PKP bila berdasarkan data yang dimiliki DJP ternyata WP memenuhi syarat untuk PKP.

Sanksi yang Berhubungan dengan Pengukuhan Sebagai PKP
Setiap orang yang dengan sengaja menyalahgunakan atau menggunakan tanpa hak Pengukuhan PKP, sehingga dapat merugikan pada pendapatan negara dipidana dengan pidana penjara paling lama 6 (enam) tahun dan denda paling tinggi 4 (empat) kali jumlah pajak terutang yang tidak atau kurang bayar.

Pencabutan Pengukuhan PKP
a. PKP pindah alamat.
b. WP Badan yang telah dibubarkan secara resmi.
c. PKP lainnya yang tidak memenuhi syarat lagi sebagai PKP.
Penghapusan NPWP dan Pencabutan Pengukuhan PKP dilakukan melalui proses pemeriksaan.

Definisi - Definisi

1. Wajib Pajak
     OP/Badan, meliputi pembayar pajak, pemotong pajak, dan pemungut pajak yang mempunyai hak dan kewajiban perpajakan sesuai dengan ketentuan perundang-undangan perpajakan.

     Sekumpulan orang dan atau modal yang merupakan satu kesatuan baik melakukan usaha maupun tidak melakukan usaha meliputi perseroan terbatas, perseroan komanditer, perseroan lainnya, BUMN, BUMD dalam nama dan bentuk apapun, firma, kongsi, koperasi, dana pensiun, persekutuan, perkumpulan, yayasan, organisasi masa, organisasi politik, dan organisasi lainnya, lembaga dan bentuk badan lainnya, termasuk kontrak investasi kolektif dan bentuk usaha tetap.
3. Pengusaha
     Orang pribadi/badan dalam bentuk apapun yang dalam kegiatan usaha atau pekerjaannya menghasilkan barang, mengimpor barang, mengekspor barang, melakukan usaha perdagangan, memanfaatkan barang tidak berwujud dari luar daerah pabean, melakukan usaha jasa, atau memanfaatkan jasa dari luar daerah pabean.
4. Masa Pajak
     Jangka waktu yang menjadi dasar bagi WP untuk menghitung, menyetor, dan melaporkan oajak yang terutang dalam jangka waktu tertentu sesuai yang ditentukan undang-undang.
5. Tahun Pajak
     Jangka waktu 1 tahun kalender kecuali bila WP menggunakan tahun buku yang tidak sama dengan tahun kalender.
6. Bagian Tahun Pajak
     Bagian dari jangka waktu 1 tahun pajak.
7. Pajak Terutang
     Pajak yang harus dibayar pada suatu saat dalam masa pajak, dalam tahun pajak atau dalam bagian tahun pajak.
8. Penanggung Pajak
     OP/Badan yang bertanggung jawab atas pembayaran pajak termasuk wakil yang menjalankan hak dan memenuhi kewajiban wajib pajak sesuai dengan ketentuan perundang-undangan.

NPWP
Nomor yang diberikan kepada wajib pajak sebagai sarana dalam administrasi perpajakan yang dipergunakan sebagai tanda pengenal diri atau identitas wajib pajak dalam melaksanakan hak dan kewajiban perpajakan.

Fungsi NPWP
1. Sebagai tanda pengenal atau identitas WP.

Biaya pembuatan NPWP
* Gratis.

Sanksi tidak ber-NPWP
